Notification of Copyright Infringement

We at xpromagz value the intellectual property rights of others and expect our users to do the same. To comply with the Digital Millennium Copyright Act of 1998 (DMCA), we’ve set up a process to quickly address any copyright infringement claims. If you’re a copyright owner or have the authority to act on their behalf, please let us know about any suspected copyright violations on our platform by sending a DMCA Notice of Alleged Infringement to our Designated Copyright Agent as detailed below.

Once we receive a valid notice, our Designated Copyright Agent will take the necessary steps, which may include removing or blocking access to the infringing content and/or terminating the user’s account if they keep violating.

To file a DMCA Notice of Alleged Infringement, please make sure to include the following details:

  1. Clearly identify the copyrighted work you believe has been infringed. If there are several works, just provide a representative list.
  2. Specify the infringing material or activity, including the URL or exact location on our site where the material can be found.
  3. Provide your contact details, including your name, mailing address, phone number, and email address.
  4. Include these statements in your notice:
  • “I genuinely believe that the use of the copyrighted material in question is not authorized by the copyright owner, their agent, or the law.”
  • “The information in this notice is true, and I am either the copyright owner or authorized to act on their behalf regarding the copyright that is allegedly being infringed.”
  1. Don’t forget to add your physical or electronic signature, like typing your full legal name.

Counter-Notification

If you think your content was taken down by mistake, you can file a counter-notice with this info:

  • Clearly identify the content that got removed and where it was located before it was taken down.
  • Include a statement, under penalty of perjury, saying you genuinely believe the removal was a mistake or a mix-up.
  • Provide your contact details, like your name, address, phone number, and email.
  • Agree to the jurisdiction of the Federal District Court for your area, or if you’re outside the U.S., for any court where we operate.
  • Sign it, either physically or electronically by typing your full legal name.

Send your counter-notice to the Designated Copyright Agent mentioned above. If everything checks out, your content might be restored unless the copyright owner informs us of a court action within 10-14 business days.

Notification of Trademark Infringement

If you think your trademark is being misused on our platform, please send us the following:

  • Your signature or that of someone authorized to represent you.
  • Information about the trademark, including registration certificates or proof of usage rights.
  • Details about the unauthorized use, with enough info to find it on our site.
  • A statement confirming that the use is unauthorized and that you’re acting in good faith.
  • A declaration that the information you provided is accurate, under penalty of perjury.

Once we receive it, we’ll look into it and take the necessary steps, including removing the infringing content if needed.

Notification of Other Intellectual Property (“IP”) Infringement

If you have other types of IP claims like patents or design rights, please send us a notice that includes:

Your signature, either physical or electronic.

Proof that you own the IP.

Details about the material that’s infringing.

A statement confirming that the use is unauthorized and that you’re acting in good faith.

A declaration that everything you’ve stated is accurate, under penalty of perjury.

We’ll take valid claims seriously and will act quickly, including removing any infringing content if necessary.

Limitation of Responsibility

We’re not a court for settling IP disputes. While we’ll respond to valid claims, we don’t make decisions on disputes. By sending a claim or counter-notice, you agree to keep us out of any legal issues that may arise.
